1,A machine operator employee with a major depressive disorder intermittently takes leaves under the Family and Medical Leave Act, resulting in alleged harassment by her employer surrounding her FMLA usage as well as a transfer to various difficult machines after her return from leave. Two months after her last FMLA leave, she is terminated for “improper phone usage.” [Hite v. Vermeer Mfg. Co., 361 F. Supp. 2d 935 (S.D. Iowa, 2005).]

2, Respond to the following discussion on in 6 to 8 sentences: (M.C)
An employee is licensed to perform certain medical procedures, but he is terminated for refusing to perform a procedure he is not licensed to perform. [O’Sullivan v. Mallon, 390 A.2d 149 (N.J. Super. Ct. Law Div. 1978).]
This falls directly under wrongful termination. Having someone perform a procedure that they are not licensed or certified to do, is a huge liability for the hospital. The employee was clearly stating that they could not do the procedure and the reason why. The hospital should already consider the liability they could face if any harm that the x-ray technician could have caused while inserting the catheter.
The firing of an employee for not performing the tasks they were instructed to undertake is against the law and constitutes an act of reprisal. The Free Will Act, which is connected to the Health Care Workers Protection Act, has been broken here.
