ABC company management has decided to revamp their performance appraisal system. As human resources director, you have been tasked with outlining a new program. The goal is to move every business unit to an MBO performance system. The company’s goals as a whole have been set for the year. Now it is time to deliver the program to the various business units. 3. Include one (1) possible solution to overcome each of the identified problems that is directly related to implementing the system with salespeople.

Employment Hassles

When Maria Suarez got her new job, she was happy. As an oil rigger, she would make enough money to support herself and her two children. After a week of working with a primarily male crew, however, her happiness was gone; her co-workers were the reason. At first, the men made unwelcome comments about her body. Then sexual graffiti mentioning her name appeared. When she came to work one morning a nude female picture was pinned to one of the rigs. Her name had been scrawled across the bottom. Maria complained to the crew supervisor, who referred her to the site manager. “Let’s ignore it for a while,” the site manager told Maria, “It’s just good fun. The men are testing you. You’ve got to fit in.”

Two weeks have passed since then and the situation has not improved. Maria feels she has the legal grounds to press this situation further. After some discussion, Maria and the site manager agreed to listen to some informal counsel before pursing this further in the courts.

You work for a consulting company that tries to mediate employment disputes before they get to the point of lawsuits. Your supervisor has asked you to provide a point paper for both Maria and the site manager. Your supervisor outlined some areas of interest to cover in your point paper.

Discuss the law that applies to Maria Suarez’s situation. List three (3) specific circumstances of Maria’s case covered by the law. Suggest two (2) actions you would take if you were the site manager. Discuss if, in this case, the employer is liable for the hostile environment created surrounding Ms. Suarez. Explain why or why not.
