In your initial post, you will write a short demand letter. You need only write the body of the letter; you do not need to include other parts of a formal business letter. (Include the body of the letter in your post; you do not need to upload an attachment.)

In your response posts, offer critiques to your colleagues on their letters, including their tone, language, and whether you believe the demand letter would be effective.

The fact pattern and law are included below:

Because of uninsured medical expenses, Dora Speckles incurred credit card charges of several thousand dollars. She was also unable to work for several months and was unable to pay the credit card bill. Once her health was restored, Dora found employment in a small business office. However, she was still unable to make payments on the credit card account. The credit card company eventually turned the account over to Collect ‘R Else Collection Agency. The collection agency learned of Dora’s employment and telephoned her there to demand payment on the account. Dora advised the agency that she was not allowed to receive any non-emergency personal calls and requested that the collection agency not call her at work. Nevertheless, the collection agency continued to call her once every day. After two weeks, Dora was fired. Her employer told her she was terminated because of all of the personal telephone calls. In Dora’s work as a receptionist, she earned $500 per week. Dora was able to find another job after two months.

Fearing that the collection agency will learn about this employment, Dora has hired your law firm to draft a demand letter to the collection agency demanding that it have no further direct contact with Dora, either at home or at her place of employment. Also, this letter must demand damages for their past conduct.

The relevant law is the Fair Debt Collection Practices Act (FDCPA), specifically sections 15 U.S.C. § 1692c and 15 U.S.C. § 1692k(a)(1)&(2).
